Our agreement with you.

1. The Service

Babinom is a mobile application that helps individuals or couples discover baby names through a swiping interface, browse and filter a multilingual catalog of names with etymologies and meanings, check how a name may be heard in other languages, and optionally connect with a partner to compare picks and narrow down a shortlist. The App is provided by Daan Vos, sole proprietor operating as Babinom, with principal place of business in Cullera, Spain (“we,” “us,” “our”).

Babinom can be used for free with a limited daily number of swipes. Premium access removes that limit and unlocks additional features, such as unrestricted filters and live name checks. What is included in each tier, and its price, is described in the App and on our website and may change. A newly paired room may receive a short free trial of Premium; each person can receive this trial only once.

Some features have fair-use limits to keep the service available for everyone — for example, a daily cap on live name checks. Where a limit applies, the App tells you when you reach it.

2. Eligibility

You must be at least 16 years old (or the minimum digital-consent age in your country, whichever is higher) to use Babinom. By using the App you confirm you meet this age requirement. The App is not intended for and may not be used by minors below this age.

3. Your Account

To use most features you must create an account. You agree to provide accurate information, keep your credentials confidential, notify us promptly at support@babinom.com if you suspect unauthorized access, and be responsible for activity under your account.

We may suspend or terminate your account for breach of these Terms, prolonged inactivity, fraud, or as required by law. You may delete your account at any time via Settings → Delete Account; deletion is permanent and removes your profile, matches, room data, and purchase history attributable to your account.

4. Partner Pairing and Rooms

Babinom lets you connect with a partner to share name picks. You may invite a partner with a code. Both partners can see each other's swipes and matches within the room.

You agree to only invite people you know, to respect that swipes, matches, and shared decisions may be visible to your partner, and to use the “Leave Room” option in Settings if you wish to end the shared session. Leaving does not delete your partner's account.

If you save surnames for your room, they are visible to your partner, and when a partner joins your room the surnames they saved are added to the shared room. Only save surnames you are comfortable sharing with your partner.

5. In-App Purchases and Subscriptions

In-app purchases are processed by Apple (App Store) or Google (Play Store) per their respective terms. Babinom uses RevenueCat to manage entitlement state. Purchases made on our website are processed by Stripe; you then redeem the purchase in the App with the link or code we send you.

In-app purchases are billed to your App Store or Play Store account. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period via your App Store or Play Store settings. Refunds for in-app purchases are governed by Apple's or Google's policies; we cannot refund those directly. For purchases made on our website, contact support@babinom.com; this does not affect any statutory withdrawal or refund rights you have as a consumer. You can restore prior purchases via Settings → Restore Purchases.

If you purchase Premium while connected to a partner, the unlocked content is accessible to both partners within the room for the duration of the entitlement.

6. Acceptable Use

You agree not to use the App for any unlawful purpose, reverse-engineer or decompile it, harvest baby-name data for resale, send false partner invites, harass other users, use offensive display names, submit custom names or suggestions that are obscene or unlawful, use name checks for anything other than considering names for a child, or circumvent paywalls and other technical restrictions. We may remove content or restrict accounts that violate these rules.

7. Name Meanings, Name Checks, and AI-Generated Content

The App displays etymological meanings, origins, and translations for thousands of names, and can check how a name, a full name, or its initials may be heard in other languages. Some of this content is drawn from public-domain sources such as Wikidata, some is generated or translated using AI language models from third-party providers, and some is editorially curated by us.

AI-generated content is produced automatically and may contain errors, omissions, or culturally insensitive phrasings despite our best efforts. We do not warrant the accuracy, completeness, or cultural appropriateness of any name meaning shown in the App, and you should not rely on it for genealogical, religious, or legal purposes.

A name check is information, not advice or a clearance. It covers only the languages it checks, reflects what an AI model produced at the time of the check, and can miss meanings, slang, regional or community usage, and associations that exist or arise later. A result in which nothing was found does not mean a name is free of negative or unwanted meanings or associations. A name check does not tell you whether a name is legally permitted where you live.

7a. Your Choice of Name

Babinom helps you explore and discuss names. The decision to give a child a name is yours alone, and you remain responsible for checking anything that matters to you before you decide — including how the name is heard in the languages and communities relevant to your family, and whether it can be registered where you live.

To the extent permitted by law, we are not responsible for the consequences of any name choice, including meanings or associations a name has or acquires that the App did not show, and for disagreements or social outcomes arising from your use of the App. Nothing in this section limits liability that cannot be limited under applicable law (see Section 10).

8. Intellectual Property

The App, including its design, code, branding, and curated dictionaries, is owned by us or our licensors and protected by copyright and trademark law. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You retain ownership of any custom names, surnames, and other content you enter, but you grant us a worldwide, royalty-free license to display, store, and process them as needed to operate the App. If you suggest a meaning, rhyme, nickname, or saying for a name, you also grant us a perpetual, worldwide, royalty-free license to review, edit, publish, and display that suggestion to other users as part of the catalog; it is shown without your name.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY EUROS (€50). WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA OR LOST PROFITS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These limitations do not apply where prohibited by applicable consumer-protection law, notably for EU and UK consumers.

11. Termination

We may terminate or suspend your access to the App at any time for breach, fraud, or as required by law. You may stop using the App or delete your account at any time. Sections 5–10 (including 7a) and 12–13 survive termination.

12. Changes to These Terms

We may modify these Terms from time to time. Material changes will be notified via the App or email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of Spain, without regard to conflict-of-laws principles. Disputes will be resolved in the competent Spanish courts, except where EU consumer-protection law gives you the right to bring proceedings in the courts of your country of residence.
